Free Standing Emergency Department licensing

On 4/21/21, the Board of Health adopted regulations pertaining to those facilities who meet the definition of a Free Standing Emergency Department (FSED) to be licensed as such by 7/1/22. These regulations became effective on 7/1/21.
 
“Freestanding emergency department,” referred to herein as FSED, means: (A) A health facility that offers emergency care and that may offer primary and urgent care services and that is either:
(1) Owned or operated by, or affiliated with, a hospital or hospital system and located more than two hundred fifty yards from the main campus of the hospital; or (2) Independent from and not operated by or affiliated with a hospital or hospital system and not attached to or situated within two hundred fifty yards of, or contained within, a hospital.
 
The term "freestanding emergency department" does not include a health facility that was licensed by the Department pursuant to Section 25-1.5-103 C.R.S. as a community clinic prior to July 1, 2010, if the facility is serving a rural community or a ski area, as defined in 6 CCR 1011- 1, Chapter 9 – Community Clinics.

Facilities that meet the definition of a Freestanding emergency department must apply for an initial license before the 7/1/22 deadline. An application for this facility type is available from the Department. For all facilities, as long as the COC is current, and there is no new construction, neither a life safety code survey nor an FGI plan review will not be required.
