Dear Licensed Healthcare Entities, The department is dedicated to improving the survey process. However, we have encountered a consistent challenge: receiving the requested documentation in a timely manner during surveys or complaint investigations. This delay prolongs the survey and extends the time surveyors need to spend on-site. To improve this process, your cooperation is crucial. Chapter 2 states: 6 CCR 1011-1, Chapter 2, part 2.10.5, the licensee is required to provide, upon request, access to or copies of the following to the Department to facilitate regulatory oversight: (A) Individual client records.   (B) Reports and information required by the Department, which may include staffing reports, census data, statistical information, and any other records specified by the Department. To ensure a smooth process, the department requests that all documentation be provided within 2 hours of the request. If any mitigating circumstances prevent you from meeting this timeline, please communicate this to the surveyors promptly. Thank you for your attention and cooperation.

For this meeting, we will continue our conversation regarding rule changes in 6 CCR 1011-1, Chapter 2 as it relates to the passage of House Bill 22-1401- Hospital Nurse Staffing Standards. We will focus on the Stakeholder process for reviewing the proposed updated rule language.   The rule changes for 6 CCR 1011-1 Chapter 2 – General Licensure Standards have two parts. The first part affects all licensed health facilities, and brings into rule the requirement from Public Health Order 20-20 that facilities maintain an infectious disease, vaccine, and mitigation plan. The second part affects the following residential care facility types: All facilities licensed under 6 CCR 1011-1 Chapter 7, e.g. Assisted Living Residences All facilities licensed under 6 CCR 1011-1 Chapter 5, e.g. Skilled Nursing Facilities All facilities licensed under 6 CCR 1011-1 Chapter 8, e.g. Facilities for Persons with Intellectual and Developmental Disabilities, Group Homes, and Intermediate Care Facilities This second part brings into rule the requirement from Public Health Order 20-20 that requires those facilities to appoint an infection control officer, and that appointee’s duties related to infection control and the mitigation of infectious diseases. Additionally, pursuant to C.R.S 25-3-113, the Stakeholder Forum consists of representatives from various types of provider facilities licensed by the department along with consumers, consumer advocates, ombudsmen, and other interested parties which meet at least four times each year for the Department to discuss and take into consideration the concerns and issues of interest to the forum members and other attendees regarding the development and implementation of rules and other matters that affect all licensed health care facilities.  Meetings are generally held virtually monthly, on the 1st Thursday of each month.

Memorandum: Home Care advisory Meeting dates

 

To: Home and Hospice Care Providers and Consumers of Home Care and Hospice Services   From: Steve Cox, Branch Chief, Home and Community Facilities    The Home Care Advisory Committee meets quarterly. The next meeting is September 15th, 1:30-4:00. However, the committee is working on Technical Assistance for the website and needs to meet more frequently in order to complete the project in a reasonable amount of time.   Last time we met on June 16, 2022, the discussion was about technical guidance that needed to be developed pertaining to each section and subsection of Chapter 26. This technical guidance and the website is being developed by the HCAC members. Thank you, this is another big project.     In order to get the project done in a more reasonable time frame, we are requesting that the members meet monthly until completion of the technical guidance and the website to support the guidance being developed. Tonie Miller will join the meetings to assist in the development of the website and be available to ask questions. By meeting monthly, the projected completion date would be February 2023. To: Home and Hospice Care Providers and Consumers of Home Care and Hospice Services   From: Steve Cox, Branch Chief, Home and Community Facilities   The Health Facilities and Emergency Medical Services Division of the Colorado Department of Public Health and Environment is currently accepting applications for the Home Care Advisory Committee.   Per statutory requirements, the Home Care Advisory Committee members serve on a voluntary basis and are appointed by the Executive Director of the Colorado Department of Public Health and Environment. This committee represents providers and consumers of home care and hospice services, the Colorado commission on the aging, county, district, or municipal public health agencies, or local boards of health, and consumer and other agencies and organizations providing service to or concerned with residents of home care and hospice.   The Home Care Advisory Committee members meet to review and discuss the rules that govern the licensing of home health/care agencies in the State of Colorado and make recommendations to both the Colorado Department of Public Health and Environment and the State Board of Health. CMS Clarifies Emergency Preparedness Exercise Exemption Due to Activation of Emergency Plan

 

To: Administrators and Directors   From: Greg Schlosser, Branch Chief, Health Facility Quality & Education Branch                                                                   CMS recognizes that as the COVID-19 Public Health Emergency continues, many facilities continue to operate under their respective activated emergency plans. The emergency preparedness rule states that facilities that activate their emergency plans are exempt from the next required full-scale community-based or individual, facility-based functional exercise. Facilities must be able to demonstrate, through written documentation, that they activated their program due to the emergency.   Now, CMS is providing further clarification to its September 28, 2020 guidance related to the exemption requirements:   The updated guidance only applies if a facility is still currently operating under its activated emergency plan. Facilities that have resumed normal operating status (not under their activated emergency plans) and were exempted from a full-scale exercise for its 2020 cycle, must conduct a full-scale exercise or an individual facility-based exercise for its next cycle. This exemption only applies to the next required full-scale exercise (not the exercise of choice), based on the facility’s 12-month exercise cycle. The cycle is determined by the facility (e.g. calendar, fiscal, or another 12-month timeframe).   For Inpatient Providers and Suppliers (§418.113(d)(2) (inpatient hospice); §441.184(d) (PRTFs), §482.15(d)(2) (hospitals); §483.73(d)(2)(LTC facilities); §483.475(d)(2)(ICFs/IID); §484.102 (HHAs); and §485.625(d)(2)(CAHs):   If the facility is still operating under its currently activated emergency plan, any currently-activated emergency plan will be recognized by surveyors as having met the full-scale exercise requirement for 2021 (even if it claimed the exemption for the 2020 full-scale exercise). If the facility claimed the full-scale exercise exemption in 2020 based on its activated emergency plan and has since resumed normal operating status, the inpatient provider/supplier is expected to complete its required full-scale exercise in 2021 unless it has reactivated its emergency plan for an actual emergency during its 12-month cycle for 2021.   For Outpatient Providers (Required 1 Annual Exercise- Alternating Full-Scale & Exercise of Choice): The outpatient providers will continue to follow the guidance issued, as the facility was either exempt from the full-scale exercise in 2020 or in 2021, depending on its cycle of testing exercises.   For Organ Procurement Organizations (OPOs) at §486.360 and Religious Nonmedical Healthcare Institutions (RNHCIs) at §403.748, we expect these organizations to continue to conduct the required paper-based, tabletop exercise or workshop at least annually.   For more specifics on these updates, we encourage you to review the CMS revised guidance and worksheet surveyors will use to determine compliance. CMS waivers released on 3/30/20

To: Federally Certified Health Care Facilities From: Margaret Mohan On March 30, 2020 the Centers for Medicare and Medicaid Services (CMS) issued blanket waivers for its federally certified facilities to help healthcare providers contain the spread of novel coronavirus 2019 (COVID-19). These waivers are retroactively effective to March 1, 2020 and do not require an 1135 waiver application. All waivers issued can be located here: COVID-19 Emergency Declaration Waivers In conjunction with the CMS waivers issued, the State Emergency Operations Center (SEOC) has developed a medical surge concept of operations to increase healthcare capability. A demonstration of that model can be found attached to this provider message. Facilities in Tiers 1 and 2 will continue to require a waiver from the Health Facilities Division. Tiers 3 and 4 will not require a waiver, and will operate under SEOC command. Colorado Health Facilities Interactive Going Live

The Health Facilities and EMS Division are pleased to announce that after 2 years of planning and effort, the Colorado Health Facilities Interactive (COHFI) state facility licensing system is nearing completion.

The "go live" date for this transition is February 3, 2020. This actually completes phase 1 of the system's development and over time, additional capabilities and features will be added. Over the coming weeks the division will be communicating details regarding the transition to the new system, and what to expect regarding Licensing, Plans of Correction, Flu Vaccination reporting and Occurrence reporting. We recognize this is a significant change to our regulated community and as with most software system changes of this nature, COHFI will likely have some bugs as it comes on-line. However, the division is confident that we can work through any glitches with everyone's support and open communication. It is extremely important that any system issues that your facility may encounter be communicated to us in a timely manner.

We will be providing training materials, manuals, etc. and are planning to be as responsive as possible to assist you during the transition to the new system. Please know that this is not the final version of this system. It will evolve based on legislative, regulatory and provider community needs in the months to come. At roll-out we will have processes in place to receive your feedback on the system and will be working with our development partners to resolve issues as quickly as possible.

Deficiency List Errors – Web Portal

To all Administrators, 

As some providers have recently experienced, the Facility Web Portal has begun to encounter a number of technical errors in relation to the accurate posting of deficiency lists (DL). First and foremost, it is important to establish that the DL that is emailed to the facility, not what is posted to the facility web portal, is the department’s official administrative document.

Unfortunately, the most prevalent error occurring with the portal system at this time is that the DLs being posted to facility web portals do not identically match the official version of the DLs that the department emails to facilities. More specifically, the facility may identify in the portal electronic copy that there are deficiencies, or tags, that are blank or may contain a slightly different version of the DL. The division will work collaboratively with facilities on these types of errors and can extend some of our standard deadlines in order for providers to have adequate time to respond with a plan of correction. 

The HFEMS Division is currently in the process of building a new web portal interface. This project is anticipated to be completed in the Summer of 2019. For the meantime, the division has implemented several additional steps in our process to help identify and address the majority of these errors. We do ask however, that during this time, all providers remain cognizant of this problem.

- Express an increased and updated knowledge of TB infection and TB disease
- Demonstrate their skill in placing and reading the TST

In keeping with the statutory requirement to routinely review and update our regulations, the department is beginning the stakeholder process this August for the regulatory review of 6 CCR 1011-1, Chapter 2 - General Licensure Standards. This chapter, which can be accessed at http://www.sos.state.co.us/CCR/GenerateRulePdf.do?ruleVersionId=6751, covers a wide range of topics, from licensure renewal to occurrence reporting to flu immunizations of health care workers.

Updated Communicable Disease Reportable Conditions List – Effective July 15, 2018

The Colorado Board of Health updates the Communicable Disease regulations (6 CCR 1009-1) and Environmental Health regulations (6 CCR 1009-1) periodically to reflect changes in public health priorities for disease surveillance. Reportable conditions may be added, removed or modified. The communicable disease regulations have been revised this year and additions and modifications became effective on July 15, 2018. Major changes include: - Addition of all suspect Candida auris statewide - Addition Extended-Spectrum Beta-Lactamase (ESBL)-producing Enterobacteriaceae (E.coli and      Klebsiella species) for Boulder County only. - Reporting of carbapenem-resistant Enterobacteriaceae has been modified to include six additional   genera. - Suspect outbreaks are now reportable by laboratories as well as healthcare providers. - Catheter-associated urinary tract infections (CAUTIs) and methicillin-resistant Staphylococcus aureus   (MRSA) bacteremia by certain healthcare facilities has also been added. This change requires facilities that are already reporting these data to the National Healthcare Safety Network (NHSN) to confer rights to CDPHE to allow the Department to have access to these data.
