Chapter 2 Update and Fee Update Reminder

 

To: All facilities and agencies From: HFEMSD Thank you to those of you who participated in the stakeholder process to implement updates to 6 CCR 1011-1, Chapter 2 - General Licensure Standards. As communicated during our final meeting of the 1294 forum on March 6, the department is moving forward with a request for rulemaking on April 16, 2025 at 10:00am at the Board of Health. A copy of the proposed changes, including changes made since the last meeting on March 6, can be found in the 1294 public meeting folder. Separately at the April 16 meeting, the Board of Health will be considering an update to Chapter 2 as part of the HB24-1417 fee update to several rule chapters of 6 CCR 1011-1.  You may provide your comments regarding the fee update to the Board in advance of the April rulemaking hearing for their consideration. To submit written comments to the Board, please email cdphe.bohrequests@state.co.us. The Board also welcomes oral testimony regarding rulemakings and the stakeholder process at the hearing. To provide oral testimony, you must sign up before 5:00 pm on April 15, 2024. The time for giving oral testimony may be limited to 3 minutes or less. Attendees may use artificial intelligence (AI) note-taking tools; however, notes taken in this manner do not constitute the official record of the meeting.   This is a kind reminder that from March 1 through June 30, 2025, two fee schedules will be in effect: the current fees and the new fees that start on July 1, 2025. This Fee Transition Period Guidance document will help you determine which fee schedule applies to your application. The new fees apply to licenses expiring on or after July 1, 2025, as well as to initial applications, change of ownership applications, and change of information applications submitted on or after July 1, 2025. As a reminder, these changes are a result of HB24-1417, which automates health facility licensing fee increases and removes the Board of Health’s authority to set fees. As a result, impacted fee amounts will no longer be listed in rule and will not go through future consumer price index rulemaking processes.  Future fee updates will be available on the facility fees website, which includes a link to the required fee schedule.
