You are invited to participate in the stakeholder process to address general updates to 6 CCR 1011-1, Chapter 22 - Birth Centers. The last general update to Chapter 22 was in 2017, and there have been several statutory and regulatory changes since that time, as well as lessons learned and changes in the general healthcare landscape. As a general update, this stakeholder process will include modifications related to Senate Bill 21-101 and Senate Bill 23-167, regarding direct-entry midwives and certified nurse midwives, respectively, and a full review of the rule chapter to bring it into compliance with existing statutory requirements and ensure its consistency with other rule chapters regarding newborn screening and newborn hearing screening. It may additionally include changes made to staff qualifications and authority, general standards of operation, terminology, and organization.
- Please note that language implementing Section 8 of Senate Bill 21-193, “Protection of a Pregnant Person’s Rights During the Perinatal Period,” as developed by The Labor and Childbirth Policy Stakeholder Group in a separate stakeholder effort undertaken from October 2023 through January 2024, will be incorporated into Chapter 22 at the end of this stakeholder process. We will not be revisiting that language as part of this general rule update as the impacted chapters and stakeholders are broader than birth centers–if that language needs revision based on changes in statute or other reasons, that stakeholder group will be reconvened for that purpose at a future date.
Stakeholder meetings for the Chapter 22 general rule updates will be held on the third Tuesday of each month, from February through August 2024. All stakeholder meetings are open to the public, and all interested parties are welcome to attend and provide input. Additionally, all stakeholders may provide input and are welcome to submit written comments to the Department at any time throughout the stakeholder process.
The third stakeholder meeting will take place on Tuesday, April 16th, 2024, from 1:00 - 3:00 pm. This meeting will be a hybrid meeting, with an option to attend either in-person or remotely, via Zoom, to ensure equal access for participation, regardless of geographic location of the attendee. Tentative rule topics for this meeting include clinical staff, nursing and other personnel, emergency care and transfers, and admission and discharge.
The in-person meeting will be at the Colorado Department of Public Health and Environment main campus, 4300 Cherry Creek S Drive, Denver, CO 80246, in Building A, Room Snow. Details regarding the stakeholder process, including process timeline, expected topic schedule, and alternate ways to provide comment are included in the stakeholder information letter. All who are interested are welcome to attend and participate. Meeting documents, including agendas, proposed rule language, presentations, etc., will be posted to the public meeting folder no later than a week before each meeting.
Notice of each meeting is provided to facilities through the Division’s portal messaging system roughly two weeks in advance of each meeting.
