To: All Stakeholders impacted by the updated Chapter 7 Assisted Living Residence Rules From: HFEMSD The proposed Assisted Living Residence rules were heard and adopted by the Board of Health on Wednesday, November 15, 2023. As this was an emergency rule packet, the rules went into effect upon adoption, meaning that the new Chapter 7 Rules went into effect on Wednesday, November 15, 2023. A regular rulemaking permanent rulemaking hearing was also held, so that the rules will stay in effect after January 14, 2024 to adopt the rule packet permanently in January 2024, before the emergency rules expire and , ensuring continuity. For practical purposes, this means the new ALR Rules went into effect immediately. This notice is being sent to you to assure your Assisted Living Residence’s awareness of the new Rules, and to encourage you to update all policies and procedures to assure overall compliance. Please note, there are several sections of the Rules that have particular dates for effectiveness expressly listed, especially related to the dementia training requirements. Please be sure to check the Secretary of State website for the published version of Chapter 7.
The updated rules will be posted on the Secretary of States website in the near future, and can be found here. For further information, please feel free to contact Steve Cox at Steve.cox@state.co.us or Jane Flournoy at jane.flournoy@state.co.us
