Contact Information Request in Response to the Staffed-Bed Capacity Data Collection Required by House Bill 22-1401

To: All Stakeholders

From: HFEMSD

The Colorado legislature passed House Bill 22-1401 in the 2022 legislative session, which seeks to ensure hospitals are prepared for a public health emergency or staffing shortage through the implementation of a robust nurse staffing committee and plan, comprehensive emergency management, and reporting on staffed-bed capacity data to the Department. This new law requires the Board of Health to promulgate rules by September 1, 2022, which require hospitals to establish a robust nurse staffing committee that is responsible for developing and evaluating a nurse-staffing plan and report its findings, plans, and evaluations to the Department. The law also requires hospitals to report staffed-bed capacity (defined by the Department) data to the Department beginning no later than September 1, 2022.

In order to ensure the information regarding the submission of required data gets to the appropriate contact person from each hospital, we are requesting each hospital fill out the form here no later than July 31, 2022. Once we receive this information, the Department will send each hospital its baseline staffed-bed capacity number as well as other information on the reporting process. You will also be able to find this information directly in EMResource.

These requirements specific to staffed bed capacity do not apply to the following types of hospitals: licensed rehabilitation hospitals, psychiatric hospitals, hospital units, long-term care hospitals, as defined at 42 U.S.C.1395X(CCC), and specialty hospitals. However, it is important to note that other provisions of HB22-1401 do apply to these hospitals (more information will follow on implementation of the entire bill).

Please submit your questions related to House Bill 22-1401 and subsequent rulemaking(s) here.
