Community Mental Health Centers-Behavioral Health Entity Licensure Requirements

 

House Bill 19-1237 was signed into law on June 3, 2019. This legislation created a new Colorado Department of Public Health and Environment (CDPHE) license type, Behavioral Health Entity (BHE), which covers community-based behavioral health facilities. The Division began issuing BHE licenses on July 1, 2021and continues to work to bring all covered facilities into compliance. 


As a designated community mental health center, your facility has been identified as one that is statutorily obligated to obtain a BHE license by July 1, 2022, in accordance with C.R.S. 25-27.6-104 (1). Please disregard this message if your facility has submitted all of the required licensure application documentation. If your facility has not completed the application, please do so immediately.


With the licensure deadline approaching, facilities are considered to be in substantial compliance with Behavioral Health Entity license requirements if they have submitted their Letter of Intent, and a completed licensing application. A completed application includes the following components:


  • A completed and signed application in COHFI
  • All supporting documentation required as a part of the application uploaded to COHFI. Supporting documentation includes:
  • Lease agreements 
  • Form 1 with signatures (required to obtain instructions to complete fingerprint background checks)
  • Business Documents (Articles of Organization/Articles of Incorporation, Operating Agreement/Bylaws/Partnership Agreement, etc.)
  • Conflicts of Interest Disclosure Form
  • Policies and Procedures
  • HCAA conforming insurance policy and Certificate of Insurance, or Division of Insurance approval letter for non-conforming policy
  • Initial BHE licensing fee. In order to be considered complete, a license application should be accompanied by the appropriate non-refundable application fee.


Please ensure all required documentation has been submitted by your facility in advance of July 1, 2022, to prevent any delays in the successful transition and continuing regulatory compliance of your facility to the BHE licensure.


In an effort to streamline information sharing for potential Behavioral Health Entity applicants, we will be continuing to hold one-hour virtual technical assistance meetings on Tuesdays, from 11am to 12pm, via this google link.
