As you may have heard, the Centers for Medicare & Medicaid Services (CMS) COVID-19 vaccine mandate was subject to a preliminary injunction in two federal courts. It temporarily blocks the implementation of the federal mandate in all 50 states.
Despite this legal action, Colorado providers are still required to comply with the state licensing requirements for vaccination mandates as set forth in 6 CCR1011-1 Chapter 2 General License Standards, Part 12. The Department will inform licensed providers and stakeholders of any changes as they arise.
On December 2, 2021, CMS released QSO 22-04 regarding its vaccination regulation. They will not enforce the new federal rule regarding vaccination of healthcare workers or requirements for policies and procedures in certified Medicare/Medicaid providers and suppliers (including nursing facilities, hospitals, dialysis facilities and all other provider types covered by the rule) while there are court-ordered injunctions in place prohibiting enforcement of this provision.
