State releases updated public health order easing facility mitigation protections for vaccinated individuals

Colorado Department of Public Health and Environment (CDPHE) released the seventh updated Public Health Order 20-20 (PHO) and guidance that updates mitigation requirements for residential care facilities serving older adults and people with disabilities. 
 
The PHO uses updated guidance from the Centers for Disease Control, the Centers for Medicare and Medicaid Services, and an Executive Order from Governor Polis allowing fully vaccinated Coloradans to go without a mask in most places. This guidance is more permissive than current federal guidance which currently still requires masking for staff, visitors, and residents in most situations. Federally regulated facilities (nursing homes and intermediate care facilities) must follow the more restrictive guidance. The CDPHE guidance allows vaccinated residents, staff, and visitors to remove their masks when not in the presence of COVID-19. In addition to the more lenient masking requirements, vaccinated staff and residents will no longer have to undergo weekly surveillance testing. Facilities in outbreak status still have to adhere to the previous state and federal mitigation measures. See the PHO 20-20 Guidance Cheat Sheet for CDPHE/CMS guidance comparisons. 
 
A key change that was made to this update moved specific directions out of the public health order and into the RCF mitigation guidance. Facilities must follow that guidance at the direction of the public health order. Other key changes in the mitigation guidance document include:
 
Submission of this information may be completed utilizing this form and must be submitted via email to residentialcarestriketeam@state.co.us on or before June 14, 2021. Additionally, if you’re vaccinated against COVID-19, you could win $1 million. As part of the Colorado Comeback Cash public health initiative, the Colorado Lottery will conduct a random weekly drawing on behalf of the Colorado Department of Health & Environment to identify one vaccinated Colorado resident each week to win a million-dollar cash prize. All Colorado residents age 18 and older who have received at least one dose of COVID-19 vaccine, as determined by eligibility rules, are automatically entered into the drawing. 
 
Drawings for $1M will be held each week for five weeks, beginning next week and ending with the final announcement on July 7. The drawing will be based on the vaccine records contained in the Colorado Immunization Information System (CIIS) at 11:59:59 PM Mountain Standard Time the Tuesday night before the drawing. It can take a few days for information to be entered into CIIS, so you should try to get vaccinated as far in advance of the drawing as possible. The last day to qualify is June 30. The winner of each drawing will be announced on June 4, June 11, June 18, June 25, and July 7.
 
This new guidance is a welcome change for residential care facilities and their families to move forward to a new normal. Given the significant changes, there will be increased information that will be forthcoming. Residential Care Strike Team Staffing Transition Plan

The Residential Care Strike Team and the Staff Shortage Fusion Center have provided staffing resources in response to the COVID-19 staffing crisis at residential facilities since late November 2020. To date, teams have covered over 5,000 shifts in 80 facilities across the state.
 
The staffing teams managed by the Strike Team are beginning to phase out and state-funded staffing resources will no longer be available after June 30, 2021. 
 
Staffing shortages in long-term and residential care facilities have long been a challenge, even prior to COVID-19, and the pandemic response has been extremely taxing on health care providers at all levels. The Strike Team is working to transition from the current, rapid-response staffing support model into longer-term plans and strategies to continue to support facilities and their staffing needs.

The Health Facilities and Emergency Medical Services Division of the Colorado Department of Public Health and Environment (CDPHE) is currently accepting applications for the Behavioral Health Entity Implementation and Advisory Committee (BHE-IAC) for the following vacant position:
 
  • A provider of substance use disorder services that meets the definition of Behavioral Health Entity as in Section 25-27.6-102 (6) (not having been subject to licensure by the department).
 
 
The BHE-IAC is responsible to:
           
  • Offer advice to CDPHE and the State Board of Health concerning the phased-in implementation of the BHE license, rules promulgated by the State Board pursuant to C.R.S. 25-27.6-101 et seq., and the implementation of the BHE licensing transition;
  • Provide ongoing advice to CDPHE regarding Behavioral Health Entities and Behavioral Health Entity licensing; and
  • Identify a coordinated and aligned process of sharing information across state departments to ensure behavioral health services are available to all residents of Colorado.
 
The BHE-IAC meetings occur on a recurring monthly basis, taking place on the second Thursday of each month. Meetings are approximately four hours in duration. In keeping with the statutory requirement to routinely review and update our regulations, the Department is conducting a stakeholder process for the regulatory review of 6 CCR 1011-1, Chapter 26 - Home Care Agencies (access the chapter at this link).

This month's meeting topics include a review of changes made since last month’s meeting in proposed Part 5.10 (Emergency Preparedness), Part 6 (Skilled Care), and Part 7 (Non-Medical/Personal Care), as well as an initial review of proposed language from the Colorado Department of Health Care Policy & Financing (HCPF) on homemaker and personal care training requirements.

Behavioral Health Entity (BHE) Transition Options for Currently Licensed Community Mental Health Centers, Community Mental Health Clinics, Acute Treatment Units and Crisis Stabilization Units Expiring in June 2021

Several community mental health centers (CMHCs), community mental health clinics (CMHcs), and acute treatment units (ATUs) have current licenses with the Colorado Department of Public Health and Environment (CDPHE) expiring in June 2021. In preparation for the newly adopted Behavioral Health Entity rules and upcoming license transition, CDPHE has contemplated several options for a successful transition for facilities from their previous license type(s) to the BHE license. The initial thought was to transition these providers to the BHE license upon their June 2021 expiration, instead of renewing their existing license. However, there are several challenges related to that:

  • The BHE application is not yet available.
  • The BHE rules are not widely available on the Secretary of State website until mid-June 2021.
  • Ensuring compliance with the BHE rules (e.g., ensuring their existing policies address all of the requirements in Chapter 3) prior to completing the BHE application will be a heavy lift for providers.
  • The BHE license cannot be issued until July 1, 2021.
  • The way the rules are worded, facilities are expecting to transition to the BHE license at their first license renewal after July 1, 2021. Chapter 3, Part 2.1.2(1) specifies that:
  • During the time period of July 1, 2021 through June 30, 2022, facilities or agencies holding a current license from the Department…shall apply to become licensed as a BHE in lieu of applying for renewal of the current license at the time that the current license is due to be renewed.
  • a. Entities holding more than one ATU, CSU, community mental health center, or community mental health clinic license shall apply to become licensed as a BHE at the earliest renewal date of all licenses held. 
 
The Department would like to give providers a workable option that allows for a thoughtful, planned transition to the BHE license. The department determined the most appropriate path forward to be: 

  • The provider will apply for a renewal of their existing CMHC, CMHc, ATU, or CSU license (expiring June 2021), and then applies for the BHE license at the first expiration of an additional license held, or for those that only have one license, applies for the BHE license between July 1, 2021 and early 2022, to assure successful transition by the June 30, 2022 deadline. When CDPHE takes action on the renewal application, the renewal license (the CMHC, CMH Clinic, ATU, or CSU license) is dated June 30, 2021 (or earlier if appropriate based on the prior license’s expiration date) to prevent issue with Section 25-27.6-104(1)(c), C.R.S.
  • Pros:
  • Consistent with the language in Chapter 3.
  • Helps ensure the intent of Section 25-27.6-104(1)(c), C.R.S., is met.
  • Gives the provider time to ensure compliance with Chapter 3 before transitioning.
  • Allows CDPHE to respond to provider applications over the length of the transition period, rather than an influx at the beginning.
  • Consistent with how other licensing transitions have taken place at CDPHE.
  • This is consistent with how providers are interpreting Chapter 3 transition language.
 
For providers who would like to pursue completing and submitting the BHE application prior to June 30, 2021, CDPHE will work with these providers on an individual basis. As a caution, for providers who wish to pursue the BHE application submission prior to the June 30, 2021 current license expiration, the provider must have a COMPLETE BHE application before the June 30 expiration, or their existing license won’t extend past June 30, 2021 (if we haven’t yet acted on the renewal). As an additional cautionary note, for providers who pursue this option, if the application is denied, then the provider is unlicensed as of July 1, 2021 as their previous license would be expired, and could no longer be renewed.
