Informal Dispute Resolution (HIDR) for certified Home Health Agencies (HHA)– Procedures Revised

All HHA have the opportunity to timely request Informal Dispute Resolution (IDR) of deficiencies cited during a survey.

Under 42 CFR 488.745 and Chapter 10 of the State Operations Manual, "Survey and Enforcement Process for HHA, "certified HHAs notified by CMS of the imposition of a Civil Money Penalty (CMP) based on the findings in the deficiency list have the option to request IDR for review of the deficiency or deficiencies upon which the CMP was imposed. 

Home Health Agency IDR requests that meet the criteria above will be reviewed by a newly created three-person committee involving a representative from the Colorado Department of Health Care Policy and Financing (HCPF), a representative from the home health community certified to participate in Medicare and/or Medicaid, and a representative from HFEMSD. 

Each member will have an alternate who will participate when the primary member has a conflict of interest.
