August 21, 2024 Board of Health Rulemaking Hearing Regarding HB23-1218 or the “Patients’ Right to Know” Act

Thank you to those of you who participated in the stakeholder process to implement Hb23-1218 or the “Patients’ Right to Know” Act. The Board of Health will be holding a rulemaking hearing related to changes to the following rule chapters on August 21, 2024 at 10:00am :


  • 6 CCR 1011-1, Chapter 4, General Hospitals 
  • 6 CCR 1011-1, Chapter 9, Community Clinics and Community Clinics with Emergency Centers
  • 6 CCR 1011-1, Chapter 10, Rehabilitation Hospitals
  • 6 CCR 1011-1, Chapter 13, Freestanding Emergency Departments (FSEDs), and
  • 6 CCR 1011-1, Chapter 19, Hospital Units


This change will incorporate language developed together with stakeholders from October 2023 through April 2025 in the above rule chapters to align them with HB23-1218, requiring notice from certain health facility types to patients regarding availability of care and non-medical denial of care related to reproductive health-care, LGBTQ+ health-care, and end-of-life health-care. 


The period for submitting written comment to the Department has passed. To provide written comment in advance of the August Board of Health meeting, please email cdphe.bohrequests@state.co.us.
