CPI Fee Increase Board of Health Rulemaking Hearing—April 17, 2024

The Board of Health will be holding a rulemaking hearing related to changes to the following rule chapters on April 17, 2024: 


  • Chapter 2 -  General Licensure Standards
  • Chapter 4 -  General Hospitals
  • Chapter 5 -  Nursing Care Facilities
  • Chapter 7 -  Assisted Living Residences
  • Chapter 8 -  Facilities for Persons with Intellectual and Developmental Disabilities
  • Chapter 9 -  Community Clinics and Community Clinics and Emergency Centers
  • Chapter 10 - Rehabilitation Hospitals
  • Chapter 13 – Freestanding Emergency Departments
  • Chapter 15 - Dialysis Treatment Clinics
  • Chapter 18 - Psychiatric Hospitals
  • Chapter 19 - Hospital Units
  • Chapter 20 – Ambulatory Surgical Center and Ambulatory Surgical Center with a   Convalescent Center
  • Chapter 21 – Hospices
  • Chapter 26 – Home Care Agencies


This change will increase all license-related facility fees. Under Sections 25-3-103(1)(c), 25-3-105(1)(a)(I)(B), and 25-27-107(1.5), C.R.S., the Board of Health may only raise fees by the annual percentage change of the consumer price index for Denver-Aurora-Lakewood (CPI). CPI-based facility fee increases were adopted in 2019 and 2020 with the intent to continue such increases. However, due to the COVID-19 pandemic and stress on health facilities, the Division suspended requesting increases. With a return to more regular business, the Division is now requesting an increase of 8.01%, the Denver-Aurora-Lakewood percentage change as calculated by the federal Bureau of Labor and Statistics and published by the Colorado Department of Local Affairs, Division of Local Government.


To review how this change will affect individual fees in Chapters 6 CCR 1011-1, 2, 4, 5, 7, 8, 9, 10, 13, 15, 18, 19, 20, 21, and 26, please see the CPI fee table. If approved by the Board of Health, fee increases are expected to be effective July 1, 2024.
