Board of Health Rulemaking Information - Chapter 4, Hospitals pertaining to House Bill 22-1401

The Board of Health will meet on February 15, 2023 to consider the third set of emergency rules for 6 CCR 1011-1, Chapter 4, Hospitals, as well as a request for permanent rulemaking. The proposed rules have been developed by the Health Facilities and Emergency Medical Services Division of the Colorado Department of Public Health and Environment pursuant to Section 25-3-128, C.R.S. and Section 25-3-105, C.R.S.

 

The proposed rules reflect new legislation, House Bill 22-1401, which seeks to ensure hospitals are prepared for a public health emergency or staffing shortage through the implementation of a robust nurse staffing committee and plan, comprehensive emergency management, and reporting on staffed-bed capacity data to the Department. This new law required the Board of Health promulgate rules by September 1, 2022, thus two emergency rulemakings have been held since August 2022. The purpose of this third and final emergency rule hearing is to maintain a consistent set of standards for Hospitals while the Department continues its stakeholder engagement process. The Department is also coming before the Board of Health in February to request a permanent rule hearing for 6 CCR 1011-1, Chapter 4, Hospitals in April 2023.

For the February 15th meeting, the Board of Health will require all individuals who wish to provide public oral testimony for the emergency rulemaking only to sign-up in advance at this link. Three (3) minutes are allotted to each individual providing public oral testimony. Signing up to testify does not guarantee there will be time for all individuals to testify at the hearing. To ensure your voice is heard, the Board encourages individuals to submit written testimony in advance of the meeting.
