Waiver Application LIVE for Hospital Staffed-bed Capacity Reporting

The Department’s waiver process is now live for facilities who wish to apply for a hardship waiver specific to its staffed-bed capacity reporting requirements pursuant to House Bill 22-1401You can find the waiver application here.


The staffed-bed reporting requirements are part of the new law that passed in Colorado’s latest legislative session and seeks to ensure hospitals are prepared for a public health emergency or staffing shortage through the implementation of a robust nurse staffing committee and plan, comprehensive emergency management, and reporting on staffed-bed capacity data to the Department. This new law required the Board of Health to promulgate rules by September 1, 2022, therefore emergency rules were adopted by the Board of Health and became effective on August 17, 2022 and will remain in effect for 120 days. The stakeholder engagement process, beginning September 20, 2022, will allow all stakeholders to provide meaningful input on the emergency rules.
