Stakeholder process for updates to 6 CCR 1011-1, Chapter 5 – Nursing Care Facilities and Chapter 7 – Assisted Living Residences related to Senate Bill 22-079 (dementia training) and Senate Bill 22-053

 

To: All Stakeholders interested in regulations related to Nursing Care Facilities and/or Assisted Living Residences From: HFEMSD   Senate Bill 22-079 was passed by the Colorado Legislature and signed by Governor Polis. It requires the Colorado Board of Health to adopt rules requiring dementia training for all direct-care staff of nursing care facilities and assisted living residences. The rules must be adopted no later than January 1, 2024.   In addition, Senate Bill 22-053 was enacted to address patient rights to visitation in certain healthcare facilities. This law covers hospitals, nursing care facilities, and assisted living residences and requires the Colorado Board of Health to adopt rules, but there is no required timeframe for adoption.   The Health Facilities and Emergency Medical Services Division is convening a stakeholder process to draft rules on these two topics for consideration by the State Board of Health. This process will cover changes to 6 CCR 1011-1, Chapter 5 – Nursing Care Facilities and Chapter 7 – Assisted Living Residences. Visitation rules for hospitals will be developed through a different work group.   The stakeholder process will begin September 28, 2022. The process will consist of monthly meetings, generally on the fourth Wednesday of the month, from 1:30 to 4:30 p.m. Meetings will be held virtually, via Zoom, to ensure equal access regardless of the geographic location of the attendees. Details regarding the process, including process timeline, expected topic schedule, and alternate ways to provide comments are included in the stakeholder invitation letter Stakeholder Information Letter. All who are interested are welcome to attend and participate. Meeting documents, including agendas, proposed rule language, presentations, etc., will be posted to the public meeting folder no later than a week before each meeting.   Notice of each meeting will be provided to facilities through the Division’s portal messaging system roughly two weeks in advance of each meeting.
