BHE: Physical Addresses for Service Locations Needed

In preparation for the Behavioral Health Entity (BHE) license going into effect as of July 1, 2021, the Colorado Department of Public Health and Environment's (CDPHE) Health Facilities Emergency Medical Services Division (HFEMSD) is seeking to collect up-to-date physical location information for all service locations currently associated with CMHCs. This includes the main administrative location, any satellite locations in which behavioral health services are offered, including walk-in/crisis services (if applicable), ATU locations (if applicable), and CSU locations (if applicable).  

Collection of this information will help CDPHE inform the Department of Public Safety's (DPS) Division of Fire Prevention and Control (DFPC) of any and all locations that will need to be issued a provisional Certificate of Compliance (CoC), defined in the proposed Chapter 3, Part 1.3.9, in an effort to assist CMHCs in achieving temporary compliance with the following rules:

  • All currently licensed CMHCs that will be transitioning into the BHE licensing chapter will require the issuance of a CoC for each physical location, as per the proposed Chapter 3, Part 2.1.2.C:
  • "Each physical location of the BHE shall meet the standards adopted by the Director of the Division of Fire Prevention and Control (DFPC), as applicable to the services provided in that location, in accordance with 6 CCR 1011-1, Chapter 2, Part 2.2.,"
  • And as per Chapter 2, Part 2.2.1.A:
  • "No person or business entity shall establish, maintain, or operate a facility or agency that is subject to section 25-3-101, C.R.S. without first having obtained a license or, in the case of governmental facilities, a certificate of compliance from the Department. 
  • (A) A licensee that is subject to fire prevention and life safety code requirements shall not provide services in areas subject to plan review except as approved by the Department of Public Safety, Division of Fire Prevention and Control.”

We are requesting that all CMHC outpatient addresses that will become part of the BHE outpatient endorsement be provided by close of business Wednesday, March 31, 2021.
