CMS waivers released on 3/30/20

On March 30, 2020 the Centers for Medicare and Medicaid Services (CMS) issued blanket waivers for its federally certified facilities to help healthcare providers contain the spread of novel coronavirus 2019 (COVID-19). These waivers are retroactively effective to March 1, 2020 and do not require an 1135 waiver application.

In conjunction with the CMS waivers issued, the State Emergency Operations Center (SEOC) has developed a medical surge concept of operations to increase healthcare capability. A demonstration of that model can be found attached to this provider message. Facilities in Tiers 1 and 2 will continue to require a waiver from the Health Facilities Division. Tiers 3 and 4 will not require a waiver, and will operate under SEOC command.


The Colorado Department of Public Health and Environment (CDPHE) continues to explore additional options to ease the burden for providers during this public health emergency and will provide updates as they become available.
